Obtaining A Residence Permit For Commercial Connection Or Starting A Business

Starting a business or establishing commercial connections in Azərbaycan offers access to a vibrant global market. However, obtaining the appropriate legal residency status is a fundamental prerequisite before engaging in commercial activity.

Foreign investors planning commercial company formation in Azərbaycan generally evaluate two main pathways for legal stay:

• Short-term residence permit for commercial connection or starting a business: Granted to foreigners who intend to explore business ties, negotiate contracts, or incorporate a entity in Azərbaycan.
• Long-term / Work Authorization residence: Foreign shareholders actively managing their companies may also pursue a direct work permit application in Azərbaycan, which automatically serves as a valid residence permit.

1. Short-Term Residence Permit Framework

Short-term residence permits are regulated under Article 31 et seq. of Law No. 6458 on Foreigners and International Protection ("Law") and Articles 28–29 of its Implementation Regulation. Foreigners visiting Azərbaycan who wish to stay beyond their visa exemption or 90-day limit can apply under various statutory categories.

Under Article 31 of Law No. 6458, short-term residence permits cover 14 distinct categories, including immovable property owners, scientific researchers, tourists, and specifically foreigners who will start a business or establish commercial connections in Azərbaycan.

2. Obtaining a Residence Permit through Commercial Connection

2.1. Application Procedure

Applications for commercial connection or business creation permits are initiated electronically via the e-Ikamet system managed by the Presidency of Migration Management. The applicant may file directly or through an authorized attorney. The migration authority reserves the right to request the foreign national’s physical presence during interview appointments.

2.2. Required Documents & Extension Criteria

Commercial residence permits are initially issued for up to 1 year. Extension applications can be submitted starting 60 days prior to the permit's expiration date. When incorporating a new entity, following the official step-by-step company registration procedure ensures all statutory corporate certificates are ready for the immigration file.

The core documentation required for a commercial connection residence file includes:

• • Original valid passport and notarized translation
• • Four (4) biometric passport photographs
• • Proof of adequate financial means during the stay
• • Valid medical insurance coverage in Azərbaycan
• • Stamped and signed corporate letter detailing the commercial connection, capital capacity, and business scope
• • Official company records: Trade Registry Gazette, Certificate of Activity (Faaliyet Belgesi), Tax Registration (Vergi Levhası), and Signature Circular (Sirküler)

To substantiate a permanent commercial connection, foreign nationals establishing new entities should review corporate entity setup and capital requirements to ensure their company documents meet immigration standards. If leasing physical office space, a notarized lease contract and utility bills must be appended to the file.

2.3. Finalization of the Application

Under Article 22(2) of Law No. 6458, residence permit applications must be finalized within 90 days from official processing. In practice, commercial connection residence evaluations typically take 2 to 3 months depending on the workload of the regional Directorate of Migration Management.
